Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of KlearFi ("KlearFi," "we," "our," or "us"), including our website, mobile experience, and any related services (collectively, the "Service"). You must explicitly accept these Terms by checking the agreement box when creating an account. By creating an account, signing in, or using the Service, you confirm your acceptance of these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use the Service. We collect your date of birth at signup to verify that you meet the age requirement. You represent that the information you provide is accurate and complete. Minors under 18 may not create accounts. KlearFi is intended for personal, non-commercial use.

3. Account

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized access or use.

We may require email verification before you can access protected areas of the Service. We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms.

4. Description of the Service

KlearFi is a financial health application that helps you understand your finances and work toward becoming debt free. The Service includes: importing and categorizing bank transactions, tracking debts and payoff progress, viewing financial health summaries, and (for Pro subscribers) AI-powered insights and live bank connections.

We offer a free tier and a paid Pro tier. Features and limits may vary by tier. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements.

KlearFi does not provide financial, tax, legal, or investment advice. The Service is for informational purposes. You should consult qualified professionals for advice tailored to your situation.

5. Payment Terms

The Pro tier requires a paid subscription. Pricing is displayed on our pricing page. By subscribing, you authorize us to charge your payment method on a recurring basis (monthly or annually, depending on your plan) until you cancel.

Payment processing is handled by Stripe. You agree to Stripe's terms and privacy policy when you provide payment information. We do not store your full payment card details.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain Pro access until that date. There are no refunds for partial periods once a charge has been made, except as stated in our refund policy.

We may change subscription prices. We will provide at least 14 days notice before any price increase. Continued use after the effective date constitutes acceptance.

6. Refunds

If you are not satisfied with your Pro subscription, you may request a full refund within 30 days of your initial purchase or renewal. Contact us at support@klearfi.com to request a refund. We will process refund requests promptly. We may deny refunds for abuse, fraud, or violations of these Terms.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of applicable laws
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Interfere with or disrupt the Service or the servers that operate it
• Use automated means (bots, scrapers) to access the Service without permission
• Upload data or content that infringes third-party rights or contains malware
• Share your account credentials with others or allow others to use your account
• Resell, redistribute, or commercially exploit the Service

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these provisions.

8. Intellectual Property

The Service, including its design, content, software, and branding, is owned by KlearFi or its licensors. You receive a limited, non-exclusive, non-transferable license to access and use the Service for personal use in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Service without our prior written consent.

You retain ownership of the data you upload. By using the Service, you grant us a license to use, store, and process your data as necessary to provide the Service, as described in our Privacy Policy.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KLEARFI AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee the accuracy, completeness, or reliability of data imported from banks, CSV uploads, or third-party integrations. You are responsible for verifying your financial information.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account for violation of these Terms, fraud, abuse, or for any other reason at our discretion.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (including Intellectual Property, Limitation of Liability, Disclaimers, Dispute Resolution, and Governing Law) will survive termination.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the United States, and the arbitrator's decision shall be final and binding. Each party shall bear its own costs, except that the arbitrator may award reasonable attorneys' fees to the prevailing party.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action or representative proceeding.

13. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

14. Changes

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. If you have an active account, we may also notify you by email. Continued use of the Service after the effective date of changes constitutes acceptance. If you do not agree, you must stop using the Service and may cancel your subscription.
